These Terms of Use govern your use of KIFOLIO, an application provided by Ki Dev Studio.
KIFOLIO is designed as an informational and portfolio tracking tool. It allows users to organize and view information related to portfolio holdings, dividends, market levels, alerts, options positions, cryptocurrency information, and user-created Investment Notes.
KIFOLIO does not provide investment, financial, tax, legal, brokerage, or accounting advice.
Information displayed by KIFOLIO should not be considered a recommendation to buy, sell, hold, or trade any security or financial product.
You are solely responsible for your own investment decisions.
Investment Notes and similar user-entered content reflect information entered solely by the user. Labels such as "Buy/Sell" are organizational labels selected by the user and do not constitute recommendations or investment advice from KIFOLIO or Ki Dev Studio.
Educational messages, daily terms, reminders, and similar content displayed by KIFOLIO are provided for general informational and educational purposes only. They are not personalized recommendations and should not be interpreted as instructions to buy, sell, hold, or trade any security or financial product.
Market prices, dividend information, calculations, historical data, and other information displayed by KIFOLIO may be provided by third-party sources.
Ki Dev Studio does not guarantee that such information is complete, accurate, current, or free from errors or delays.
Dividend amounts, yields, ETF and fund distributions, payment schedules, projected income, portfolio values, profit or loss figures, simulations, and other calculations are estimates only and may be incomplete, inaccurate, or delayed.
Dividend and distribution calculations may be affected by delayed or missing market data, user-entered information, rounding, corporate actions, distribution changes, special distributions, or calculation limitations. Historical dividends and distributions do not guarantee future payments.
Simulation results, including dividend income, dividend reinvestment, target investment amounts, target share quantities, yields, and historical or projected returns, are hypothetical estimates and do not represent actual investment performance. Results may vary due to dividend timing, reinvestment prices, market prices, rounding, delayed or incomplete market data, and other factors. Fractional shares may not be available through all brokerages. Past performance does not guarantee future results. These calculations are provided for informational purposes only and do not constitute investment advice.
Calculations may use underlying dividend or market data with greater precision than the rounded values displayed in the app, so results may differ slightly from calculations performed using displayed percentages or amounts.
Historical return calculations are estimates and may vary due to dividend timing, reinvestment prices, corporate actions, rounding, and available market data. Past performance does not guarantee future results.
Corporate action information, including stock splits, reverse splits, mergers, symbol changes, and similar events, may be delayed, incomplete, unavailable, or incorrectly reported by third-party data sources. KIFOLIO may not identify or display every corporate action.
Options-related calculations are estimates and may differ from actual brokerage calculations, collateral requirements, margin requirements, assignment outcomes, or account treatment.
KIFOLIO does not execute securities transactions, hold customer funds or securities, or act as a broker, investment adviser, financial institution, or fiduciary.
KIFOLIO is not affiliated with or endorsed by Charles Schwab, Fidelity, or any other brokerage unless expressly stated.
You are responsible for verifying information before making any financial or investment decision.
KIFOLIO may allow users to import portfolio or transaction information from brokerage-provided CSV files. Brokerage file formats, descriptions, transaction codes, and data conventions may change without notice. KIFOLIO attempts to interpret supported files but does not guarantee that imported information will be complete, accurate, free from duplication or omission, or correctly classified. You are responsible for reviewing imported holdings, cash, options, and other information for accuracy.
You are also responsible for maintaining appropriate backups of information stored locally within the application and for safeguarding backup files created by KIFOLIO. Backup files may contain personal portfolio information. Ki Dev Studio is not responsible for loss, disclosure, corruption, or unauthorized access resulting from how users store or share their backup files, except where liability cannot be excluded by applicable law.
Ki Dev Studio may modify, update, suspend, or discontinue features of KIFOLIO at any time.
We do not guarantee uninterrupted availability of the application, website, market data services, or supporting infrastructure.
To the maximum extent permitted by applicable law, Ki Dev Studio will not be liable for losses or damages resulting from investment decisions, market movements, inaccurate, incomplete, or delayed market data, imported data errors, calculation or simulation errors, application errors, alerts or missed alerts, service interruptions, third-party services, or use of KIFOLIO.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KI DEV STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, INVESTMENT VALUE, INVESTMENT OPPORTUNITY, OR OTHER FINANCIAL LOSS ARISING OUT OF OR RELATED TO KIFOLIO OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF KI DEV STUDIO ARISING OUT OF OR RELATING TO KIFOLIO OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE USER FOR KIFOLIO DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
The limitations in this section apply regardless of the legal theory on which a claim is based, including contract, tort, negligence, strict liability, or otherwise.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
KIFOLIO and its related services, calculations, simulations, alerts, information, and data are provided on an "AS IS" and "AS AVAILABLE" basis to the maximum extent permitted by applicable law.
Ki Dev Studio does not warrant that KIFOLIO will be uninterrupted, error-free, accurate, complete, current, secure, or suitable for any particular purpose.
KIFOLIO does not guarantee that alerts, notifications, dividend events, corporate actions, price movements, or other events will always be identified, delivered, or displayed.
KIFOLIO may rely on third-party market data providers, hosting providers, payment platforms, brokerage-generated files, and other third-party products or services.
Ki Dev Studio does not control and is not responsible for the availability, accuracy, completeness, policies, acts, omissions, interruptions, or errors of third-party services.
The availability of information through KIFOLIO does not constitute an endorsement of any third-party provider, brokerage, security, ETF, cryptocurrency, financial product, or investment strategy.
Third-party services and data may be changed, delayed, suspended, or discontinued without notice.
All investment and financial decisions are made solely by the user.
KIFOLIO does not determine whether any security, ETF, cryptocurrency, option, investment strategy, allocation, dividend strategy, or other financial product is suitable or appropriate for any user.
Alerts, target allocations, Investment Notes, historical performance, dividend estimates, simulations, portfolio calculations, options calculations, Market Drop information, and other KIFOLIO features are organizational and informational tools and are not instructions or recommendations to enter, exit, modify, or maintain an investment position.
Users are responsible for performing their own research and, where appropriate, consulting a qualified financial, investment, tax, accounting, or legal professional.
KIFOLIO, the KIFOLIO name, website design, application design, graphics, and related materials are owned by or licensed to Ki Dev Studio unless otherwise stated.
All product names, trademarks, service marks, and registered trademarks are the property of their respective owners. KIFOLIO is not affiliated with or endorsed by those trademark owners unless expressly stated.
KIFOLIO may offer a free trial followed by a paid subscription. Available subscription options may include monthly and annual plans. Current prices, trial periods, and billing terms will be displayed through Google Play before purchase.
Unless canceled before the end of the applicable trial or billing period, a subscription may automatically convert to a paid subscription or renew in accordance with the terms presented through Google Play.
Users can manage or cancel subscriptions through their Google Play account. Ki Dev Studio does not directly process complete payment card information for Google Play purchases.
The price, trial period, renewal terms, and other purchase conditions shown through Google Play at the time of purchase will control if they differ from information displayed on the KIFOLIO website or other promotional materials.
You agree not to misuse KIFOLIO or its supporting services, including by attempting unauthorized access, intentionally interfering with service operation, abusing APIs, using automated systems to place unreasonable load on Ki Dev Studio infrastructure, or using the service in violation of applicable law.
Except where prohibited by applicable law, you may not reverse engineer, decompile, disassemble, or attempt to circumvent technical protections associated with KIFOLIO.
Ki Dev Studio may suspend or restrict access to KIFOLIO's online services when reasonably necessary to protect the service, enforce these Terms, prevent misuse, maintain security, or comply with applicable law.
Your use of KIFOLIO is also subject to our Privacy Policy, which explains how information is handled when you use KIFOLIO and its supporting services.
These Terms shall be governed by the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.
To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to KIFOLIO or these Terms shall be brought in a court of competent jurisdiction located in Texas.
Nothing in this section limits any rights that cannot lawfully be waived under applicable consumer-protection law.
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by applicable law.
Failure by Ki Dev Studio to enforce any provision of these Terms shall not constitute a waiver of that provision or of the right to enforce it later.
These Terms, together with the Privacy Policy and any additional terms presented in connection with KIFOLIO, constitute the agreement between you and Ki Dev Studio concerning your use of KIFOLIO, except where applicable law provides otherwise.
These Terms may be updated from time to time. Updated Terms will be posted on this page with a revised effective date.
Continued use of KIFOLIO after updated Terms become effective may constitute acceptance of those updated Terms where permitted by applicable law.
